Terms of Service

1. What this software is

Proxima Gateway ("the Software") is a self-serve management tool. It consists of two parts:

• A dashboard hosted by Proxima Gateway operators ("we", "us") where you configure proxy settings, install the binary on your own server, and view logs.
• A proxy binary that you install on your own server. The binary handles inbound traffic according to the configuration you provide.

We provide the Software. We do not host, operate, monitor, or manage your servers, your network traffic, your backends, or your end users.

2. Your responsibilities

You — the operator using the Software — are solely responsible for:

• The server(s) you install Proxima Gateway on
• The traffic that flows through the proxy you operate
• The backends you point the proxy at
• The end users you serve and the content they access
• Compliance with all applicable laws, regulations, and third-party terms (data protection, content licensing, export controls, sanctions, telecom rules, etc.)
• Any contractual obligations you have with your own customers or users
• Securing access to your dashboard account and your servers
• Backups, redundancy, monitoring, and disaster recovery for anything that depends on the Software

We are not a party to your relationship with your end users. We do not see, store, or process your end users' traffic — that flows directly between your end users and the servers you operate.

3. Acceptable use

You agree not to use the Software to:

• Violate any law or third-party right
• Send spam, malware, phishing content, or anything intended to deceive or defraud
• Facilitate unauthorized access to systems you don't own
• Bypass authentication, security, or access controls
• Engage in denial-of-service attacks
• Distribute material that infringes intellectual property rights
• Distribute child sexual abuse material, content that incites violence, or other content prohibited by law

We reserve the right to suspend or revoke any license at any time if we believe — at our sole discretion — that the Software is being used for any of the above. License revocation puts the proxy into a 5-day grace window, after which the proxy stops serving traffic on the next heartbeat.

4. No warranty

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND UNINTERRUPTED OR ERROR-FREE OPERATION.

We do not warrant that the Software will meet your requirements, be uninterrupted, secure, or error-free. You use the Software at your own risk.

5. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST DATA, BUSINESS INTERRUPTION, OR LOSS OF GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SOFTWARE, REGARDLESS OF THE LEGAL THEORY UNDER WHICH SUCH DAMAGES ARE SOUGHT, AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

In no event shall our total liability to you for any and all claims relating to the Software exceed the amount you paid us for the Software in the twelve months preceding the event giving rise to the claim, or US $100, whichever is greater.

6. Indemnification

You agree to indemnify and hold us harmless from and against any and all claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Software, (b) your violation of these Terms, (c) your violation of any law or third-party right, or (d) any content or traffic transiting your installation of the proxy.

7. Service availability

The dashboard is provided on a best-effort basis. We do not guarantee any specific uptime, response time, or availability. Scheduled maintenance, network outages, or service disruptions may occur without notice.

The proxy binary continues to serve traffic on your server even when the dashboard is unreachable, until either the license key expires or you stop the service yourself.

8. Changes

We may revise these Terms at any time by posting an updated version on this page. Continued use of the Software after a revision constitutes acceptance of the updated Terms.

9. Termination

We may terminate or suspend your access to the dashboard and revoke any license at any time, with or without cause and with or without notice. Upon termination your obligations under these Terms (including limitation of liability and indemnification) survive.

10. Governing law

These Terms are governed by the laws of the jurisdiction in which the Proxima Gateway operators are based. Any dispute arising out of or relating to these Terms shall be resolved in the competent courts of that jurisdiction.
